If a union organizing drive has started in your company, anything that a supervisor or manager says or does may become the subject of an Unfair Labour Practice charge filed by the union with the Manitoba Labour Board. Under the Manitoba Labour Relations Act, the Labour Board can automatically certify a union if it finds that the employer has committed an Unfair Labour Practice. This means that the Board does not have to conduct a vote - regardless of the number of employees who have indicated an interest in a union.

It's best to be extremely careful about what you say or do. Remember, you may not yet have been served with certification papers from the Labour Board, but a drive could be underway.

Before you act or react, get informed on what can be said or not, and what can be done or not.
